Appeal Filed in Rhode Island Hernia Patch Infection Lawsuit

C.R. Bard has filed an appeal of a $1.5 million verdict in a hernia patch lawsuit in Rhode Island.

The hernia patch and medical device manufacturer claims that the expert witnesses used by the prosecution did not provide acceptable evidence linking the company’s hernia patch with the plaintiff’s injuries.

The lawsuit was filed by Christopher Thorpe and his wife against C.R. Bard and their Davol subsidiary. The lawsuit claims the defective design of the hernia patch caused it to break inside of him, causing internal injuries and a sepsis infection.

The trial ended in late August, 2010, with the jury siding with the plaintiffs, awarding Thorpe and his wife $1.5 million in damages.

C.R. Bard filed notice of the appeal last week, moving the case to the U.S. Court of Appeals for the First Circuit.
