Jury awards $1.3M to hernia-patch victim

A jury in Rhode Island awarded $1.3 million dollars to a plaintiff and his wife who claimed that he suffered serious internal injuries when a plastic ring on

his Kugel-mesh hernia patch failed due to defective design. The jury decided that the company who produced the hernia patch was liable for the defective product, as well as failure to warn patients of the potential dangers associated with that type of medical procedure.

The plaintiffs claimed that the defective patch caused a serious abdominal wall abscess and fistula, which required multiple surgeries to correct. While the hernia patch was initially championed as a breakthrough procedure when first introduced, multiple recalls and defective product claims have been brought against companies who produce the patches, including Davol, Inc, C.R. Bard, Inc, and Alloderm.
